By accessing or using MadeYouASong ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

MadeYouASong is operated from Delaware, United States. We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the revised terms.

2. Description of Service

MadeYouASong is a personalized song creation service. Users provide details about a recipient and occasion, and we produce a custom, AI-generated song delivered digitally via email and a shareable link.

Songs are created using artificial intelligence music generation technology. Each song is unique and produced based on the information you provide during the ordering process.

3. Orders and Payment

All prices are listed in US Dollars (USD) and include the cost of song creation and digital delivery. Payments are processed securely through Stripe. We never store your payment card details on our servers.

By placing an order, you authorize us to charge the selected amount to your payment method. Orders are confirmed once payment is successfully processed.

We offer two delivery tiers:

• Standard Delivery — your song is delivered within 24 hours of payment.
• Rush Delivery — your song is delivered within 2 hours of payment.

Delivery times are estimates and not guarantees, though we make every effort to meet them.

4. Refund and Remake Policy

We want you to love your song. If you are not satisfied with the result:

• Free Remake: We will remake your song at no additional cost. You can provide feedback on what you'd like changed, and we'll create a new version.
• Refund: If after a remake you are still not satisfied, we will issue a full refund to your original payment method.

5. User Accounts

An account is created for you when you place an order. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You may request deletion of your account and associated data at any time by contacting us at [email protected].

6. Ownership and Usage Rights

Upon successful payment, the song is yours. You own full rights to your custom song and may use it however you wish, including:

• Playing, sharing, and downloading the song
• Posting on social media or any other platform
• Using in personal or commercial projects

We may occasionally reach out to ask if we can feature your song on our website or social media as an example of our work. We will always ask for your permission first and will never use your song for promotional purposes without your explicit consent.

7. Acceptable Use

You agree not to use the Service to create songs that:

• Contain hateful, threatening, defamatory, or harassing content
• Infringe on the intellectual property rights of others
• Promote illegal activities
• Are intended to harm, bully, or intimidate any person

We reserve the right to refuse or cancel any order that violates these guidelines, with a full refund issued.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind, either express or implied. MadeYouASong shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the specific order giving rise to the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
